Terms & Conditions

Definition of terms used in this document: The Seller - Lark and Larks Ltd, to whom all payments become due for goods and services provided. The Purchaser - the Individual, Firm, or Limited Company from whom an order has been accepted. The Contract - The goods and services that will be supplied by the Seller are set out in the Order Acceptance. Any subsequent changes requested by the Purchaser will incur an additional charge. The order price is determined at the time of Order Acceptance, and full payment becomes immediately due. This must be paid by the Purchaser on acceptance of the order (unless other terms have been agreed with the Seller). Order Acceptance is the point at which the contract is established. Items which are made, or modified, to meet the Purchaser’s requirements may not be cancelled after Order Acceptance, unless the Seller agrees. This contract is written and agreed in conformity with English Law. Nothing in these Terms and Conditions affects the Purchaser’s statutory rights. 

Delivery Lead Times: Proposed delivery lead times are given only for guidance. The actual delivery date will be agreed between Seller and Purchaser after Order Acceptance. Liability: The Seller is not liable for any loss or delays arising from circumstances beyond their reasonable control – including, but not limited to, failure by its own suppliers to deliver on time, goods that are damaged in-transit (see below), or goods that have to be replaced for any reason. Please note: Images are for illustration purposes only and some products may vary slightly from the images shown. 

Damaged Goods: If goods are damaged during transit, The Seller is not liable for their replacement, unless the damage is (a) noted on the carrier’s delivery documents, or (b) reported to The Seller within 48 hours of receipt of goods. Replacement Items: Items that are replaced due to damage, manufacturing faults, or any other reason, will be subject to normal delivery lead times as stated on the original Order Acceptance. The Seller shall make reasonable effort to reduce the lead time, but can accept no liability for subsequent delays or consequential losses. 

Faulty Goods: If the Purchaser finds fault or manufacturing defect with the items ordered within 24 months of delivery, those items will be replaced or repaired (at the Seller’s discretion) without charge. However, all ordered items are subject to availability; if an item has been discontinued, a suitable substitute will be offered. Please note: where doors are fitted near heat sources, appropriate heat deflectors must be used - failure to do so may void any guarantee. See below for specific Terms & Conditions from each supplier. By registering with the Lark and Larks website - whether by saving a quote, placing an order, or other means - you agree to Lark and Larks contacting you with promotional offers and news. You may opt out at any time. Your contact information will not be passed to third parties except when required by a manufacturer shipping directly to you.

BA (Bella/Pronto/Zurfiz): 9.6.3 Products supplied which are placed near heat sources such as ovens, radiators, grills, boiling Kettles, toasters etc are not covered by the guarantee unless protected by suitable heat strips with a suitable gap left for heat escape. 9.6.4 Products situated below a sink, or covering a dishwasher/washing machine are not covered, unless the damage is anything other than excessive steam or water contact.

Unique: The liability of the Seller for any defect in the quality or condition of the Goods or their failure to correspond with specification is subject to the following conditions: - 1. the Seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller’s instructions (whether oral or in writing), misuse or alteration or repair of the Goods without the Seller’s approval.

Uform: 10.1: The Seller sells all Goods in its current published price list with the benefit of the following guarantee, namely that the all Goods will be free from defects in materials and workmanship under normal use for 5 years from the date of delivery under this contract. This guarantee shall be the Buyer’s exclusive remedy in respect of claims relating to the quality and/or fitness for purpose of Goods in substitution, to the fullest extent permitted by law, for all other remedies in respect thereof and is subject to the following conditions: 10.1.8 for the avoidance of doubt, defects shall not include the consequences of normal wear and tear or damage caused by or arising from accident, misuse, abuse, improper installation, excessive exposure to heat or moisture from integrated or freestanding appliances, maintenance or cleaning.

PWS: The warranty guarantees that the following products supplied by PWS will be free from faults or defects in workmanship and materials for the following time periods from delivery to you, subject to the terms and conditions of the Contract (where applicable) and the terms set out below: a. All doors and door range accessories: 6 years 8.2.2 any defect arises from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instructions (whether oral or in writing), misuse or alteration or repair of the Goods without our prior approval.
